What Law 5293/2026 changed for inheritance sales
Previously, to transfer a property acquired through inheritance, parental gift or donation, the related tax had to be paid in advance. Many sales were frozen for years because the heirs did not have the cash to pay the tax up front — especially when the property itself was their only asset.
Under the new law, the tax can be withheld by the notary from the sale price at the moment of transfer. You no longer need to find money out of pocket before you sell — the tax is paid to the state from the amount you receive. The result: transfers that were stuck are now moving again.
